Terms of Service — Portraify

1. Acceptance of Terms

Portraify is operated by CAMEL DEV LLC, a Wyoming limited liability company ("Company", "we", "us", or "our"). By accessing or using Portraify ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. You must be at least 18 years old to use Portraify.

2. Description of Service

Portraify is an AI-powered headshot generation service. You upload one or more photos and our system produces a professional portrait using generative AI. The output is provided for your personal and professional use.

3. Your Content

You retain ownership of any photos you upload ("Input Photos") and the headshots we generate from them ("Output"). By uploading, you grant Portraify a limited, non-exclusive license to process, store, and display your Input Photos and Output solely to provide the Service to you, including maintaining your generation history. We do not use your photos to train AI models.

You represent and warrant that:

You own or have the necessary rights to the photos you upload.
The photos depict only yourself or individuals who have consented.
Your use of the Service does not violate any applicable law.

4. Generated Output

The AI-generated headshots ("Output") are provided to you for your personal and commercial use. Portraify does not claim ownership of your Output. You acknowledge that generative AI may produce imperfect results and that no specific likeness, quality, or accuracy is guaranteed.

For passport and ID photo formats, Output is an AI-regenerated image, not an unedited copy of your Input Photo. Many government and institutional authorities require submissions to be an original, unedited photograph. Portraify does not guarantee that Output will be accepted for any official passport, visa, or ID submission, and you are responsible for confirming compliance with the requirements of the relevant authority before submitting it.

5. Credits and Payments

The Service operates on a credit system. Credits are purchased in advance and consumed when a headshot is generated. All purchases are final and non-refundable once credits have been used. Unused credits do not expire but have no cash value and are non-transferable. If our own quality checks flag a result — because it is a low match to your reference photos, or because the framing does not meet what an ID photo format requires — no credit is charged for that generation.

Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service.

6. Prohibited Use

You agree not to use the Service to:

Upload photos of other individuals without their consent.
Generate content that is deceptive, defamatory, or illegal.
Attempt to reverse-engineer, scrape, or abuse the Service.
Violate any applicable laws or third-party rights.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.

8. Limitation of Liability

To the maximum extent permitted by law, Portraify shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid in the 30 days preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above. Continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Wyoming, USA.
